General Terms and Conditions for Use of the Website and for Purchases and Sales via www.scandles.bg – Online Store of ScandleBG EOOD

These General Terms and Conditions govern the procedure, manner, and conditions for purchases and sales via www.scandles.bg – an online store owned by ScandleBG EOOD. These General Terms and Conditions constitute a contract of sale between ScandleBG EOOD and the Client. ScandleBG, hereinafter referred to as Scandles, provides the Client with the opportunity to purchase products offered through the online store by placing an order and paying the corresponding sale price, in compliance with and adherence by the Client to these General Terms and Conditions. The Client can place valid orders for the purchase of goods offered through the online store after completing an order form, thereby expressing agreement with these General Terms and Conditions and undertaking to comply with them. Scandles reserves the right to change these General Terms and Conditions at any time, by promptly publishing these changes on its website  www.scandles.bg, together with a notice of the changes.

1. General Provisions

For the purposes of these General Terms and Conditions, the listed concepts are used with the following meaning:
ScandleBG EOOD is a company registered in the Commercial Register at the Registry Agency, with UIC: 206792426, with registered office and management address: Sofia, 21G Georgi Raichev St., offering products for sale through the online store www.scandles.bg
www.scandles.bg is a website with an integrated platform for online purchase and sale of scented candles, diffusers, accessories, and others.
By using www.scandles.bg you declare your agreement with these General Terms and Conditions.

"Products" means: scented candles, diffusers, accessories and all other goods offered in the Scandles online store;
Each of the listed items is described with its main characteristics and sale price including VAT.
"Client" means a natural or legal person who has filled in the order form on www.scandles.bg and has agreed to these General Terms and Conditions. By placing an order/request, the Client - natural person declares the truthfulness of the data provided by them.

2. Orders/Purchase Requests
To be entitled to place valid orders for the purchase of items offered through www.scandles.bg, the Client must complete an order form, thereby also declaring their agreement with these General Terms and Conditions.

When filling out an order form, you are required to voluntarily provide your personal data such as: first name, last name, delivery address, phone number, and email. The collected information will be processed and used solely in connection with the processing of orders and the provision of services you wish to receive from us and our website. This data will not be provided, sold, or rented to third parties in any form, or used for other purposes. After submitting a request for order processing, the Client may receive a phone call or email notification regarding the order placement and processing.
Every purchase request by the Client through www.scandles.bg, based on these General Terms and Conditions, is placed and executed in performance of the purchase and sale agreement between the parties. In case of a dispute as to whose will it is to be bound by the text of these General Terms and Conditions, the person who submitted their data and agreed to these General Terms and Conditions shall be considered a party to the agreement.

2.1. Submitting an order/purchase request

An Order/Purchase Request is submitted by the Client by performing the following actions sequentially:
1. The Client clicks the virtual button “Home or Products” and gains access to the products offered by the online store;
2. The Client determines the type and quantity of goods to add to their cart/shopping basket;
3. After clicking the virtual button “Cart/Shopping Basket with total quantity and total price displayed” visualized on the site, the Client sees what they have added to their cart/shopping basket;
4. When proceeding to complete their order, the Client enters their personal data – Name, address, phone number and all necessary information for the purpose of the order and delivery.
5. The request for purchase of goods via www.scandles.bg is considered completed after clicking the "Order" button and agreeing to the "site rules and conditions".
If an incomplete, incorrect or wrong address and/or telephone number is provided when placing the order/request, the same shall be considered invalid and Scandles shall not be obliged to fulfill it.

2.2. Acceptance of the order/request

The purchase request is accepted by Scandles by sending a message to the Client's email address containing its details – item/items, sale price, characteristics, delivery data. The request becomes effective between the parties after checking availability and confirming the order with a phone call and/or email confirmation.

3. Delivery

The requested goods for purchase are delivered to the delivery address specified by the Client within the following deadlines:
no later than 3 (three) working days – for the territory of the country.
Scandles does not guarantee the availability of the ordered items. In case of impossibility to fulfill its obligations, due to not having the requested goods in stock, Scandles, within 24 (twenty-four) hours after receiving the purchase request, informs the Client about the exhaustion of the goods by calling the phone number provided during registration or by sending a message to the email address provided by the Client. Scandles may change the composition of the order at the Client's request.

The goods are delivered appropriately packaged, according to their type and the transport for delivery by a courier company.

The goods are handed over to the Client or to a third party who accepts and confirms receipt of the same on behalf of the Client by signing the accompanying documents. In the event that the Client does not accept/does not collect, is not found within the delivery period at the address specified by them, or access and conditions for handing over the goods are not provided within this period, Scandles is released from its obligation to deliver the requested goods for purchase. The Client may confirm their wish to receive the goods even after the expiration of the delivery period during which they were not found at the address, bearing all costs for the repeated delivery. In this case, a new delivery period begins to run from the moment of confirmation under the previous sentence.

4. Prices and payment methods

For all orders, a delivery fee is charged according to the courier company's tariff. You have the option to use Econt or SPEEDY courier companies with the option of receiving the order at the courier company's office or to a personal address provided by the client with delivery through one of the two specified courier companies.

Free delivery is available for orders over BGN 150.

Payment methods:

  • Cash on delivery (upon delivery by courier)
  • Card payment (credit or debit)
  • Bank transfer: ?
    • Immediately after placing the order
    • With an invoice

* If bank payment is specified, the purchase request for goods via www.scandles.bg is considered completed after clicking the “Order” button, agreeing to the “site rules and conditions” and confirmation of payment by Scandles.

5. Client rights

A client who is a consumer within the meaning of the Consumer Protection Act has the right, without owing compensation or penalty and without stating a reason, to withdraw from the concluded contract for the purchase of goods through www.scandles.bg, by returning the goods within 14 (fourteen) working days from the date of receipt. In the event that the Client withdraws from the concluded contract within the period specified in the previous sentence, they must send a statement of withdrawal from the concluded contract to Scandles  and return the goods at their own expense with intact integrity and packaging, unused, and in appropriate condition. The statement of withdrawal should be submitted to 0878860386 or scandlesbg@gmail.com. The Client is obliged to store the received goods, ensuring the preservation of their quality and safety. The right of withdrawal does not apply to the delivery of goods that, due to their nature, cannot be returned or are subject to rapid spoilage, or there is a risk of deterioration of their quality characteristics.

The Client has the right to refuse to accept the ordered goods when:
• the delivered goods clearly do not correspond to what was ordered by them, and this can be established through a simple inspection;
• the goods were damaged during transportation.
After receiving the goods, the Client has the right to request their return if there is a discrepancy between the goods and what was agreed upon, which could not have been established during a simple inspection of the goods.
In the listed cases, the Client may request that the delivered goods be replaced with goods corresponding to the purchase request submitted by them by sending a corresponding written request to Scandles.

Scandles is obliged to refund the full amount paid by the Client, no later than 15 (fifteen) working days, starting from the date on which the returned and inspected goods were received.

Scandles takes care to keep the information on www.scandles.bg always up-to-date, but does not guarantee its accuracy and completeness.

Scandles does not guarantee that access to the online store will be uninterrupted, timely, secure, and error-free, insofar as this is beyond the capabilities, control, and will of Scandles. Scandles is not responsible for not providing access to www.scandles.bg, as well as for the non-processing or untimely processing of purchase requests in the event of circumstances beyond its control – cases of force majeure, accidental events, problems in the global Internet network and in the provision of services beyond the control of Scandles .
The Client is obliged to compensate Scandles  for all damages, expenses, and paid attorney's fees incurred in connection with their culpable non-performance of their obligations under these General Terms and Conditions.

For matters not regulated by these General Terms and Conditions, the provisions of the current legislation of the Republic of Bulgaria shall apply.

These General Terms and Conditions are effective from January 1, 2022.
